Coming into force

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 113B(9) and 125 of the Police Act 19971 as extended and modified by the Police Act 1997 (Criminal Records) (Jersey) Order 20102.

Citation, commencement and extent1

These Regulations may be cited as the Police Act 1997 (Criminal Records and Registration) (Jersey) (Amendment) Regulations 2012 and come into force on 10th September 2012.

These Regulations extend to Jersey.

Amendment of the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 20102

Regulation 9 of the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 20103 is omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations revoke regulation 9 of the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010 which prescribed which police forces were “relevant” police forces for the purposes of providing information to be disclosed on an enhanced criminal record certificate under section 113B of the Police Act 1997 (c. 50). Under changes made by section 82(3) of the Protection of Freedoms Act 2012 (c. 9), police forces no longer need to be prescribed, rather the Secretary of State will determine the relevant chief officer force in relation to a certificate.
