interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Police and Crime Commissioner (Disqualification) (Supplementary Provisions) Regulations 2012 and shall come into force on 15th<span ukl:Name="NonBreakingSpace"> </span>September 2012.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>In these Regulations, “the <abbr title="Police Reform and Social Responsibility Act 2011 c. 13">2011 Act</abbr>” means the Police Reform and Social Responsibility Act<span ukl:Name="NonBreakingSpace"> </span>2011.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Entities under the control of local policing body or other body or chief officer of police</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>For the purposes of section 65(1)(i) of the <abbr title="Police Reform and Social Responsibility Act 2011 c. 13">2011 Act</abbr> (disqualification from election or holding office as police and crime commissioner: police grounds), an entity (“E”)—</p></intro><level class="para1" eId="regulation-2-1-a"><num>(a)</num><content><p>is under the control of a local policing body in the circumstances specified in paragraph (2);</p></content></level><level class="para1" eId="regulation-2-1-b"><num>(b)</num><content><p>is under the control of a body mentioned in section 65(1)(h) of the <abbr title="Police Reform and Social Responsibility Act 2011 c. 13">2011 Act</abbr> in the circumstances specified in paragraph (3);</p></content></level><level class="para1" eId="regulation-2-1-c"><num>(c)</num><content><p>is under the control of a chief officer of police in the circumstances specified in paragraph (4).</p></content></level></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>The circumstances specified in this paragraph are that appointments to E are or may be made or confirmed by—</p></intro><level class="para1" eId="regulation-2-2-a"><num>(a)</num><content><p>a police and crime commissioner,</p></content></level><level class="para1" eId="regulation-2-2-b"><num>(b)</num><content><p>the Mayor’s Office for Policing and Crime,</p></content></level><level class="para1" eId="regulation-2-2-c"><num>(c)</num><content><p>the Common Council of the City of London in its capacity as a police authority,</p></content></level><level class="para1" eId="regulation-2-2-d"><num>(d)</num><content><p>a committee or sub-committee of the Common Council in that capacity, or</p></content></level><level class="para1" eId="regulation-2-2-e"><num>(e)</num><content><p>a joint committee on which a person or body referred to in any of sub-paragraphs (a) to (c) is represented.</p></content></level></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>The circumstances specified in this paragraph are that appointments to E are or may be made or confirmed by any of the bodies mentioned in section 65(1)(h) of the <abbr title="Police Reform and Social Responsibility Act 2011 c. 13">2011 Act</abbr>.</p></content></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><content><p>The circumstances specified in this paragraph are that appointments to E are or may be made or confirmed by a chief officer of police.</p></content></paragraph><paragraph eId="regulation-2-5"><num>(5)</num><content><p>It does not matter for the purposes of paragraphs (2) to (4) whether the appointments are made or confirmed by the person or body referred to acting alone or jointly with another person or body.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Entities under the control of a relevant council</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>For the purposes of section 66(5)(b) of the <abbr title="Police Reform and Social Responsibility Act 2011 c. 13">2011 Act</abbr> (disqualification from election or holding office as police and crime commissioner: other grounds), an entity (“E”) is under the control of a relevant council<authorialNote class="footnote" eId="f00002" marker="2"><p>See section 66(7) of the Police Reform and Social Responsibility Act 2011 for the definition of “relevant council”.</p></authorialNote> in the circumstances specified in paragraph (2) or (3).</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><intro><p>The circumstances specified in this paragraph are that appointments or elections to E are or may be made or confirmed by—</p></intro><level class="para1" eId="regulation-3-2-a"><num>(a)</num><content><p>a relevant council,</p></content></level><level class="para1" eId="regulation-3-2-b"><num>(b)</num><content><p>a committee or sub-committee of a relevant council,</p></content></level><level class="para1" eId="regulation-3-2-c"><num>(c)</num><content><p>a joint committee on which a relevant council is represented, or</p></content></level><level class="para1" eId="regulation-3-2-d"><num>(d)</num><content><p>a person appointed or elected to E by a council or committee referred to in any of sub-paragraphs (a) to (c).</p></content></level></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><content><p>The circumstances specified in this paragraph are that E is a company which, in accordance with Part 5 of the Local Government and Housing Act 1989<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1989/42">1989 c.42</ref>. Part 5 is repealed by section 261(1) of, and Schedule 18 to, the Local Government and Public Involvement in Health Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/2007/28">2007 (c.28)</ref>.
