conferred by sections 85AA(3)(f), 85AC(7) and 89(4) of the Further and Higher Education Act 1992<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1992/13">1992 c. 13</ref>. Sections 85AA and 85AC were inserted by section 244(1) of the Apprenticeships, Skills, Children and Learning Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/2009/22">2009 (c.22)</ref> and were amended by sections 3(2), 3(4) and 54(1) of and paragraph 8 of Schedule 13 to the Education Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/2011/21">2011 (c.21)</ref>. See section 90(5) of the <abbr title="Further and Higher Education Act 1992 c. 13">1992 Act</abbr> and section 579 of the Education Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1996/56">1996 (c. 56)</ref> for the definition of “regulations”.</p></authorialNote>:</p><formula name="enactingText"><p>In accordance with section 89(3A) of that Act<authorialNote class="footnote" eId="f00002" marker="2"><p>Subsection (3A) of section 89 of the <abbr title="Further and Higher Education Act 1992 c. 13">1992 Act</abbr> was inserted by section 244(2) of the Apprenticeships, Skills, Children and Learning Act 2009.</p></authorialNote>, a draft of this instrument was laid before, and approved by a resolution of, each House of Parliament.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Further Education Institutions and 16 to 19 Academies (Specification and Disposal of Articles) Regulations 2012 and come into force on 1st September 2012.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Further and Higher Education Act 1992 c. 13">1992 Act</abbr>” means the Further and Higher Education Act 1992;</p></content></hcontainer><hcontainer name="definition"><content><p>“firework” means a device within the meaning of section 1 (introduction) of the Fireworks Act 2003<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/2003/22">2003 c. 22</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“image” means—</p></intro><level class="para1"><num>(a)</num><content><p>a moving or still image (produced by any means), or</p></content></level><level class="para1"><num>(b)</num><content><p>data (stored by any means) which is capable of conversion into an image within sub-paragraph (a);</p></content></level></hcontainer><hcontainer name="definition"><content><p>“pornographic image” means an article containing an image of such a nature that it must reasonably be assumed to have been produced solely or principally for the purpose of sexual arousal;</p></content></hcontainer><hcontainer name="definition"><content><p>“tobacco” includes the items listed in section 7(5) of the Children and Young Persons Act 1933<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1933/12">1933 c. 12</ref>. Section 7(5) was amended by section 1(1)(c) of the Protection of Children (Tobacco) Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1986/34">1986 c. 34</ref>.</p></authorialNote>.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Prohibited items</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>Each of the following articles is a prohibited item for the purposes of sections 85AA and 85AC of the <abbr title="Further and Higher Education Act 1992 c. 13">1992 Act</abbr>—</p></intro><level class="para1" eId="regulation-3-1-a"><num>(a)</num><content><p>tobacco and cigarette papers;</p></content></level><level class="para1" eId="regulation-3-1-b"><num>(b)</num><content><p>a firework;</p></content></level><level class="para1" eId="regulation-3-1-c"><num>(c)</num><content><p>a pornographic image.</p></content></level></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>An article specified in paragraph (1) is not a prohibited item where the student who is suspected of having the item in his or her possession is aged 18 or over.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Disposal of articles</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>Paragraphs (2) to (5) prescribe what must or may be done by a member of staff who, under section 85AC(1) of the <abbr title="Further and Higher Education Act 1992 c. 13">1992 Act</abbr>, seizes an article specified in regulation 3.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>In the case of tobacco and cigarette papers, the member of staff may retain or dispose of the tobacco or cigarette papers and its or their container.</p></content></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><content><p>In the case of a firework, the member of staff may retain or dispose of the firework and its container.</p></content></paragraph><paragraph eId="regulation-4-4"><num>(4)</num><intro><p>In the case of a pornographic image, the member of staff may dispose of the image unless the member of staff has reasonable grounds for suspecting that—</p></intro><level class="para1" eId="regulation-4-4-a"><num>(a)</num><content><p>the image is an image to which section 62(2) (possession of prohibited images of children) of the Coroners and Justice Act 2009<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/ukpga/2009/25">2009 c. 25</ref>. Section 62 of the Coroners and Justice Act 2009 makes it an offence for a person to be in possession of a prohibited image of a child.</p></authorialNote> applies; or</p></content></level><level class="para1" eId="regulation-4-4-b"><num>(b)</num><content><p>the image is an image to which section 63 (possession of extreme pornographic images) of the Criminal Justice and Immigration Act 2008<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/2008/4">2008 c. 4</ref>. These are tobacco and cigarette papers, fireworks, and pornography. These items are not prohibited items where the student suspected of possessing them is aged 18 or over.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 makes provision for the disposal of the specified articles. Cigarettes and fireworks may be kept or disposed of. Any pornography may be disposed of unless possession constitutes a specified offence.
