A person guilty of an offence under regulation 33(1) or regulation 34(1) or (2) is liable—
a
on summary conviction to a fine not exceeding the statutory maximum; or
b
on conviction on indictment to a fine, to imprisonment for a term not exceeding two years, or to both.

A person guilty of an offence under regulation 34(3) is liable on summary conviction to a fine not exceeding level 3 on the standard scale.
