The Lord Chancellor, with the concurrence of the Senior President of Tribunals, makes the following Order in exercise of the power conferred by section 7(9) of the Tribunals, Courts and Enforcement Act 20071.

Citation and commencement

1.

This Order may be cited as the First-tier Tribunal and Upper Tribunal (Chambers) (Amendment) Order 2012 and comes into force on 20th July 2012.

Amendment to the First-tier Tribunal and Upper Tribunal (Chambers) Order 2010

The First-tier Tribunal and Upper Tribunal (Chambers) Order 20102 is amended as follows.

In article 10(a) (appellate functions of the Administrative Appeals Chamber of the Upper Tribunal), for sub-paragraph (viii) substitute—

“(viii)

against a decision in a road transport case;”.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order amends article 10(a)(viii) of the First-tier Tribunal and Upper Tribunal (Chambers) Order 2010 (S.I. 2010/2655) in consequence of the recent expansion of road transport related cases over which the Upper Tribunal has jurisdiction. As well as jurisdiction over appeals from decisions of traffic commissioners, jurisdiction has been conferred on the Upper Tribunal to hear appeals under the Goods Vehicles (Licensing of Operators) Act (Northern Ireland) 2010 (2010 c.2 (N.I.)) from decisions of the Department of the Environment in Northern Ireland. The amended Order describes all such appeals as road transport cases.
