The Secretary of State for Communities and Local Government, in exercise of the powers conferred by section 83(1) and (4) of the Local Government Act 19721, makes the following Order:

Citation, commencement and application1

This Order may be cited as the Local Elections (Declaration of Acceptance of Office) Order 2012 and comes into force on 9th July 2012.

This Order applies in relation to England only2.

Form of declaration of acceptance of office2

For the purposes of section 83(1) and (4) of the Local Government Act 1972, the prescribed form of the declaration of acceptance of office is as set out in the Schedule to this Order.

Revocation of order3

The Local Elections (Declaration of Acceptance of Office) Order 20013 is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order prescribes the form of declaration of office for members and elected mayors of country, district, London borough and parish councils in accordance with section 83 of the Local Government Act 1972. The declaration must be made within two months of election for county, district and London borough councillors or, in the case of parish councillors, in accordance with section 83(4) of the 1972 Act.

Article 3 revokes the Local Elections (Declaration of Acceptance of Office) Order 2001.

A full impact assessment has not been produced in relation to this Order as no impact on the private and voluntary sectors is foreseen.
