(This note is not part of the Order)
Under section 8 of the Pests Act 1954 (c. 68), it is an offence to use or knowingly to permit the use of any spring trap, other than a trap that has been approved by Order, for animals or in circumstances for which it is not approved.
This Order revokes and replaces the Spring Traps Approval Order 1995 (S.I. 1995/2427), which approved types of spring trap for use in England and Wales (and which has subsequently been revoked in so far as it applied to Wales) and three subsequent variation Orders which applied in respect of England only (article 3).
Article 2 specifies approved traps, namely those listed in Column 1 of the Schedule and others which are equivalent in all relevant respects to those so listed. Conditions attached to the approval of each type of trap are specified in Column 2 of the Schedule.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
