The Lord President of the Council, in exercise of the powers conferred by section 36 (1) and (2) of the Representation of the People Act 1983(1), makes the following Rules.

The Lord President of the Council has consulted the Electoral Commission about these Rules in accordance with section 7(1) and (2)(d) of the Political Parties, Elections and Referendums Act 2000(2).

Citation and commencement

1.  These Rules may be cited as the Local Elections (Parishes and Communities) (England and Wales) (Amendment) Rules 2011 and come into force on 24th March 2011.

Amendment of the Local Elections (Parishes and Communities) (England and Wales) Rules 2006

2.—(1) Schedule 2 (Rules for Conduct of an Election of Councillors of a Parish or Community where Poll is not taken together with Poll at another Election) and Schedule 3 (Rules for Conduct of an Election of Councillors of a Parish or Community where the Poll is taken together with the Poll at a Relevant Election or Referendum) to the Local Elections (Parishes and Communities) (England and Wales) Rules 2006(3) are amended as follows.

(2) After rule 16(3) in each Schedule insert—

(3A) If a candidate who is the subject of an authorisation by two or more parties under rule 5(3) so requests, the ballot paper must contain, against the candidate’s particulars, the registered emblem (or, as the case may be, one of the registered emblems) of one of those parties..

(3) In rule 16(4) in each Schedule, after the words “under paragraph (3)” insert “or (3A)”.

EXPLANATORY NOTE

(This note is not part of the Rules)

The Rules amend Schedule 2 (Rules for Conduct of an Election of Councillors of a Parish or Community where Poll is not Taken Together with Poll at another Election) and Schedule 3 (Rules for Conduct of an Election of Councillors of a Parish or Community where Poll is Taken Together with Poll at a Relevant Election or Referendum) to the Local Elections (Parishes and Communities) (England and Wales) Rules 2006. The amendments in each case enable a candidate who is standing for election on behalf of two or more registered political parties to request that the ballot paper may feature, alongside the candidate’s particulars, an emblem registered by one of those political parties.
