<P2para><Text>Section 75 of the Marine and Coastal Access Act 2009<FootnoteRef Ref="f00003"/> (exemptions for certain dredging <Abbreviation Expansion="Et cetera" xml:lang="la">etc</Abbreviation> activities) is amended as follows.</Text>

<P3para><Text>that the activity involves the relocation of sediments inside surface waters,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para><Text>that the activity is for the purpose of—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para><Text>managing waters or waterways,</Text></P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para><Text>preventing floods,</Text></P4para>
</P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para><Text>mitigating the effects of floods or droughts, or</Text></P4para>
</P4>
<P4>
<Pnumber>iv</Pnumber>
<P4para><Text>land reclamation, and</Text></P4para>
</P4>

<P3para><Text>that it is proved to the satisfaction of the appropriate licensing authority for the area in which the activity is to be undertaken that the sediments are not hazardous waste.</Text>

<P><Text>These Regulations amend section 75 of the Marine and Coastal Access Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/2009/23" id="c00002" Class="UnitedKingdomPublicGeneralAct" Year="2009" Number="0023">2009 (c. 23)</Citation> by adding further conditions to the exemption from marine licensing for dredging or spoil disposal activities carried out by, or on behalf of, harbour authorities.</Text></P>
<P><Text>The further conditions are consistent with the limits of the exclusion from Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2008/0098" id="c00003" Class="EuropeanUnionDirective" Year="2008" Number="98">2008/98/EC</Citation> of the European Parliament and of the Council on waste (<Acronym Expansion="Official Journal">OJ</Acronym> No L 312, 22.11.2008, p 3) under Article 2(3). They apply to activities involving the relocation of sediments inside surface waters, where this is done for specified purposes and where it can be proved to the appropriate licensing authority that the sediments are not hazardous waste.</Text></P>
<P><Text>An impact assessment which shows the anticipated cost of compliance to businesses may be obtained from the Marine Licensing team, Area 2C, Nobel House, 17 Smith Square, London SW1P 3JR and is available alongside the Explanatory Memorandum and the instrument on <ExternalLink Title="legislation.gov.uk" URI="http://www.legislation.gov.uk">www.legislation.gov.uk</ExternalLink>.</Text></P>
