The Pensions Act 2008 (Commencement No.11) Order 2011

This Order may be cited as the Pensions Act 2008 (Commencement No.11) Order 2011.
Commencement of provisions2.
The following provisions of the Pensions Act 2008 come into force on 3rd January 2012—
(a)
(b)
section 104 (additional pension etc: minor and consequential amendments) in so far as it relates to the provisions listed in paragraph (c) of this article;
(c)
in Schedule 4—
(i)
paragraph 1 in so far as it relates to the provisions listed in sub-paragraphs (ii) to (xii) of this paragraph,
(ii)
paragraphs 2 and 3,
(iii)
paragraph 4(1) in so far as it relates to the provisions listed in sub-paragraph (iv) of this paragraph,
(iv)
(v)
paragraph 5,
(vi)
paragraph 6(1) in so far as it relates to paragraph 6(2),
(vii)
paragraph 6(2),
(viii)
paragraph 7, except for sub-paragraph (a),
(ix)
paragraph 8, except for sub-paragraph (a),
(x)
paragraph 9(1) in so far as it relates to the provisions listed in sub-paragraph (xi) of this paragraph,
(xi)
paragraph 9(2) and (3), except for sub-paragraph (2)(c),
(xii)
paragraphs 11 and 12.

This Order brings into force provisions of the Pensions Act 2008 (c.30) (“the Act”) on 3rd January 2012.
Article 2(a) brings section 49 of the Act (monitoring of employers’ payments to personal pension schemes) into force, for the purpose only of conferring power to make regulations under section 111A of the Pension Schemes Act 1993 (c.48). Section 49 amends section 111A so that the term “employee” includes a “jobholder”.
Article 2(b) and (c) brings into force certain provisions of Schedule 4, which make minor and consequential amendments to the Social Security Contributions and Benefits Act 1992 (c.4) in relation to retirement pensions under Part 2 of that Act.
The following provisions of the Pensions Act 2008 have been brought into force by Statutory Instruments which were made before this Order was made.
