The Money Laundering (Amendment No.2) Regulations 2011

Coming into force
The Treasury are a government department designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the prevention of money laundering and terrorist financing;
The Treasury, in exercise of the powers conferred on them by section 2(2) of the European Communities Act 1972, make the following Regulations:
Citation and commencement1
These Regulations may be cited as the Money Laundering (Amendment No.2) Regulations 2011 and come into force on 31st March 2012.
Change of supervisory authority for Northern Ireland credit unions2
The Money Laundering Regulations 20073 are amended as follows.
a
In regulation 23(1)—
i
after sub-paragraph (a)(v) insert—
vi
credit unions in Northern Ireland;
ii
omit sub-paragraph (f)(i).
b
In the definition of “designated authority” in regulation 36—
i
in paragraph (b), insert “and” after “the Commissioners;”; and
ii
omit paragraph (d), together with “and” immediately preceding it.

In the definition of “officer” in regulation 36—
i
in paragraph (c), insert “or” after “the OFT;”; and
ii
omit paragraph (e), together with “or” immediately preceding it.

The Treasury must from time to time—
a
carry out a review of regulation 2,
b
set out the conclusions of the review in a report, and
c
publish the report.

The report must in particular—
a
set out the objectives intended to be achieved by the amendments made by regulation 2,
b
assess the extent to which those objectives are achieved, and
c
assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

The first report under this regulation must be published before the end of the period of five years beginning with 31st March 2012 in conjunction with the Treasury’s report setting out the conclusions of its review under article 3 of the Financial Services and Markets Act 2000 (Exemption) (Amendment No 2) Order 20114.

Reports under this regulation are afterwards to be published at intervals not exceeding five years.
