The Secretary of State has consulted the Scottish Ministers, the Welsh Ministers(1) and the Department of the Environment in accordance with section 1(4) of the Waste and Emissions Trading Act 2003(2) and has obtained their agreement in accordance with section 2(2) to (4) of that Act.
The Secretary of State makes these Regulations in exercise of the powers conferred by sections 1(1) and 2(1) of that Act.
A draft of this instrument has been approved by a resolution of each House of Parliament pursuant to section 28(2) of that Act.
1. These Regulations—
(a)may be cited as the Landfill (Maximum Landfill Amount) Regulations 2011; and
(b)come into force on 1st October 2011.
2. The maximum amount of biodegradable municipal waste by weight in tonnes that may be sent to landfill from each area specified in the table in each scheme year that is a target year must be in accordance with the table.

These Regulations specify the maximum amount by weight of biodegradable municipal waste that is allowed to be sent each target year to landfills, for each of the United Kingdom, England, Scotland, Wales and Northern Ireland, as required by section 1(1) of the Waste and Emissions Trading Act 2003 (c. 33). The amounts set under regulation 2 are consistent with the obligations of the United Kingdom under Article 5(2) of Council Directive 1999/31/EC on the landfill of waste (OJ No L 182, 16.7.1999, p 1).
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
Under section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32), the functions of the National Assembly for Wales were transferred to the Welsh Ministers.
