The Secretary of State makes the following Regulations in exercise of the powers conferred on him by section 2(2) of the European Communities Act 1972(1).

The Secretary of State has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to food (including drink)(2).

As required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(3), there has been open and transparent public consultation during the preparation and evaluation of these Regulations.

Title and commencement

1.  These Regulations may be cited as the Food (Jelly Mini-Cups) (Emergency Control) (England) (Revocation) Regulations 2011 and come into force on 31st March 2011.

Revocation

2.  The Food (Jelly Mini-Cups) (Emergency Control) (England) Regulations 2009(4) are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulation)

1.  These Regulations revoke the Food (Jelly Mini-Cups) (Emergency Control) (England) Regulations 2009 (S.I.2009/3230).

2.  Those Regulations implemented in relation to England Commission Decision 2004/374/EC suspending the placing on the market and import of jelly mini cups containing the food additives E400, E401, E402, E403, E404, E405, E406, E407, E407a, E410, E412, E413, E414, E415, E417 and/or E418 (OJ No. L118, 23.2.2004, p.70) (“Commission Decision 2004/374/EC”). Commission Decision 2004/374/EC has been repealed by Commission Directive 2010/69/EU amending the Annexes to European Parliament and Council Directive 95/2/EC on food additives other than colours and sweeteners (OJ No. L279, 23.10.2010, p.22).

3.  A full impact assessment has not been produced for this instrument as no impact on the public or voluntary sectors is foreseen.
