CHAPTER 2 E+W MAXIMUM AMOUNTS OF LOANS

F1 2009 cohort students with full entitlement ... E+W

74.—(1) This regulation applies to a 2009 cohort student with full entitlement F2 ....

(2) Subject to Chapter 4 of this Part and paragraph (5), where the student's household income exceeds £50,778, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F3 £4,856];

  (ii)

  for a student in category B, [F4 £8,764];

  (iii)

  for a student in category C, [F5 £7,455];

  (iv)

  for a student in category D, [F6 £6,263];

• Subject to paragraph (4), Y is £1 for every complete [F7 £4.01] by which the household income exceeds £50,778.

(3) Subject to Chapter 4 of this Part and paragraph (5), where the student's household income exceeds £50,778, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is equal to where—

X is—

(i)

for a student in category A, [F8 £4,405];

(ii)

for a student in category B, [F9 £7,979];

(iii)

for a student in category C, [F10 £6,483];

(iv)

for a student in category D, [F11 £5,795];

Subject to paragraph (4), Y is £1 for every complete [F12 £4.01] by which the household income exceeds £50,778. where—

(4) Where the same household income is used to assess the amount of a statutory award for which two or more persons qualify, Y in paragraphs (2) and (3) must be divided by the number of such persons before being deducted from X.

(5) Where the maximum amount of loan for living costs is calculated in accordance with paragraph (2) or (3) and is less than the minimum level for the academic year specified in regulation 105, the minimum level for the academic year is payable.

(6) Subject to Chapter 4 of this Part, where the student's household income exceeds [F13 £50,724] but does not exceed £50,778, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is—

(a) for a student in category A, [F14 £4,856];

(b) for a student in category B, [F15 £8,764];

(c) for a student in category C, [F16 £7,455];

(d) for a student in category D, [F17 £6,263].

(7) Subject to Chapter 4 of this Part, where the student's household income exceeds [F18 £50,724] but does not exceed £50,778, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is—

(a) for a student in category A, [F19 £4,405];

(b) for a student in category B, [F20 £7,979];

(c) for a student in category C, [F21 £6,483];

(d) for a student in category D, [F22 £5,795].

(8) Subject to Chapter 4 of this Part, where the student's household income is [F23 £50,724] or less, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year other than the final year of a course that is not an intensive course is equal to X–Y where—

• X is—

  (i)

  for a student in category A, [F24 £4,856];

  (ii)

  for a student in category B, [F25 £8,764];

  (iii)

  for a student in category C, [F26 £7,455];

  (iv)

  for a student in category D, [F27 £6,263];

• Y is the maintenance grant amount.

(9) Subject to Chapter 4 of this Part, where the student's household income is [F28 £50,724] or less, the maximum amount of loan for living costs for which a student to whom this regulation applies qualifies in respect of an academic year that is the final year of a course that is not an intensive course is equal to where—

• X is—

  (i)

  for a student in category A, [F29 £4,405];

  (ii)

  for a student in category B, [F30 £7,979];

  (iii)

  for a student in category C, [F31 £6,483];

  (iv)

  for a student in category D, [F32 £5,795];

• Y is the maintenance grant amount.

(10) In this regulation, the “maintenance grant amount” is—

(a) where the student F33 ... qualifies under Chapter 6 of Part 5 for a maintenance grant, half the amount of the maintenance grant payable; [F34 and]

F35 (b) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .

(c) where no maintenance grant is payable, nil.
