Coming into force
The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by paragraph 4(a) of Schedule 1 to the Education Act 20021:
Citation and commencement1.
These Regulations may be cited as the School Governance (Contracts) (England) (Revocation) Regulations 2011 and come into force on 20th July 2011.
Revocation2.
The School Governance (Contracts) (England) Regulations 20052 are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations revoke the School Governance (Contracts) (England) Regulations 2005 which require the governing bodies of maintained schools to have regard to the Code of Practice on Workforce Matters in Public Sector Service Contracts (commonly referred to as the “Two-Tier Code”) when entering into a contract which involves a transfer of staff . This follows a decision by the Government to withdraw the Code.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
