The Academies Act 2010 (Commencement No. 2) Order 2011

The Secretary of State for Education makes the following Order in exercise of the power conferred by section 19(2) of the Academies Act 20101.

Citation1

This Order may be cited as the Academies Act 2010 (Commencement No. 2) Order 2011.

Provision coming into force on 1st August 20112

1st August 2011 is the day appointed for the coming into force of section 12(4) of the Academies Act 2010.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force section 12(4) of the Academies Act 2010 (“the Act”) on 1st August 2011.

Section 12(1) of the Act provides that where Academy proprietors are qualifying Academy proprietors as defined in section 12(2), they are charities. Section 12(4) of the Act amends Schedule 2 to the Charities Act 1993 to provide that qualifying Academy proprietors are exempt charities and will thus not need to register with, or be regulated by, the Charities Commission. An exempt charity is regulated by its principal regulator appointed under section 13(4) of the Charities Act 2006.
