<Text>These Regulations may be cited as the Visits to Children in Long-Term Residential Care Regulations 2011 and come into force on 25th April 2011.</Text>

<P1group RestrictExtent="E+W" RestrictStartDate="2016-04-06"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-f7d52a9999f064797c15fc36726a2229"/>2</Pnumber><P1para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“the 1989 Act” means the Children Act 1989;</Text></Para></ListItem><ListItem><Para><Text>“A” means an accommodated child within the meaning of paragraph 8A(2) of Schedule 2 to the 1989 Act<FootnoteRef Ref="f00003"/> <Addition ChangeId="key-53da04d169941063b793ecd6abbe892b-1785941609197" CommentaryRef="key-53da04d169941063b793ecd6abbe892b">or, as the case may be, a child accommodated in accordance with section 120 or 121 of the Social Services and Well-being (Wales) Act 2014</Addition>;</Text></Para></ListItem><ListItem><Para><Text>“R” means a representative of the responsible local authority;</Text></Para></ListItem><ListItem><Para><Text>“responsible local authority” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>where a notification has been made under section 85(1)<FootnoteRef Ref="f00004"/> of the 1989 Act, the responsible authority as defined in section 85(3);</Text></Para></ListItem><ListItem NumberOverride="aa"><Para><Text> <Addition ChangeId="key-f2862e63a278ae05b84890eca17dc097-1785941721682" CommentaryRef="key-f2862e63a278ae05b84890eca17dc097">in Wales, where a notification has been made under section 120(2) of the Social Services and Well-being (Wales) Act 2014, the responsible authority as defined in section 120(3) of that Act;</Addition> </Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>where a notification has been made under section 86(1)<FootnoteRef Ref="f00005"/> of the 1989 Act, the local authority<FootnoteRef Ref="f00006"/> within whose area the establishment is carried on;</Text></Para></ListItem><ListItem NumberOverride="bb"><Para><Text> <Addition ChangeId="key-e94f020e6ed38925b87eb452da088686-1785941855750" CommentaryRef="key-e94f020e6ed38925b87eb452da088686">in Wales, where a notification has been made under section 121(2) of the Social Services and Well-being (Wales) Act 2014, the local authority within whose area the establishment is carried on;</Addition> </Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“working day” means any day other than a Saturday or a Sunday, Christmas Day, Good Friday or a bank holiday in England and Wales under the Banking and Financial Dealings Act 1971<FootnoteRef Ref="f00007"/>.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2016-04-06"><Title>Frequency of visits</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-ed26baa7a0b88085cba4a3a58d9b2cbd"/>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>Where a notification has been made with respect to A, and A’s needs for the purposes of the 1989 Act <Addition ChangeId="key-f5e177375553433e41560813f877c5f5-1785942004195" CommentaryRef="key-f5e177375553433e41560813f877c5f5">or, as the case may be, the Social Services and Well-being (Wales) Act 2014</Addition>  have not been assessed by any local authority in the twelve months ending with the date of notification, the responsible local authority must make arrangements to ensure that R visits A–</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/1/a" id="regulation-3-1-a"><Pnumber>a</Pnumber><P3para><Text>within seven working days of that notification, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/1/b" id="regulation-3-1-b"><Pnumber>b</Pnumber><P3para><Text>thereafter, at intervals of not more than six months.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/2" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/2" id="regulation-3-2"><Pnumber>2</Pnumber><P2para><Text>Where A’s needs have been assessed in the twelve months ending with the date of notification, the responsible local authority must make arrangements to ensure that R visits A–</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/2/a" id="regulation-3-2-a"><Pnumber>a</Pnumber><P3para><Text>within three months of that notification, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/2/b" id="regulation-3-2-b"><Pnumber>b</Pnumber><P3para><Text>thereafter, at intervals of not more than six months.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/3" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/3" id="regulation-3-3"><Pnumber>3</Pnumber><P2para><Text>In addition to visits in accordance with paragraph (1) or (2), the responsible local authority must make arrangements to ensure that R visits A—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/3/a" id="regulation-3-3-a"><Pnumber>a</Pnumber><P3para><Text>whenever reasonably requested to do so by A, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/3/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/3/3/b" id="regulation-3-3-b"><Pnumber>b</Pnumber><P3para><Text>whenever the responsible local authority is satisfied that circumstances require A to be visited in order to safeguard and promote A’s welfare.</Text></P3para></P3></P2para></P2></P1para></P1></P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2011-04-25">
<Title>Circumstances of visit</Title>

<Pnumber><CommentaryRef Ref="key-f958c11597981d4d531239fa90e97da5"/>4</Pnumber>
<P1para>
<Text>On each visit, R must speak to A in private unless –</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/4/a" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/4/a" id="regulation-4-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>A, being of sufficient age and understanding to do so, refuses,</Text>
</P3para></P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/4/b" id="regulation-4-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>R considers it inappropriate to do so, having regard to A’s age and understanding, or</Text>
</P3para></P3>

<Pnumber>c</Pnumber>

<Text>R is unable to do so.</Text>
</P3para></P3>
</P1para>
</P1>
</P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2016-04-06"><Title>Reports of visits</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5" id="regulation-5"><Pnumber><CommentaryRef Ref="key-27823d1289d1a8255037a0e639ece362"/>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>R must provide a written report of each visit to the responsible local authority.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>R’s report must include R’s assessment of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/2/a" id="regulation-5-2-a"><Pnumber>a</Pnumber><P3para><Text>A’s wishes and feelings about the accommodation, so far as R has been able to ascertain them,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/2/b" id="regulation-5-2-b"><Pnumber>b</Pnumber><P3para><Text>whether A’s welfare is adequately safeguarded and promoted,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/2/c" id="regulation-5-2-c"><Pnumber>c</Pnumber><P3para><Text>whether further visits by R, in addition to those set out in regulation 3(1) or (2), are required in order to safeguard and promote A’s welfare,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/2/d" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/2/d" id="regulation-5-2-d"><Pnumber>d</Pnumber><P3para><Text>any services which R considers appropriate to be made available with a view to promoting contact between A and A’s family, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/2/e" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/2/e" id="regulation-5-2-e"><Pnumber>e</Pnumber><P3para><Text>any other steps that should be taken by the responsible local authority exercising its functions under the 1989 Act  <Addition ChangeId="key-d494a2f8fd0b09c51e6b564955bd7fa4-1785942130204" CommentaryRef="key-d494a2f8fd0b09c51e6b564955bd7fa4">or, as the case may be, the Social Services and Well-being (Wales) Act 2014</Addition> to safeguard and promote A’s welfare<FootnoteRef Ref="f00008"/>.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/3" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/3" id="regulation-5-3"><Pnumber>3</Pnumber><P2para><Text>The responsible local authority must give a copy of the report to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/3/a" id="regulation-5-3-a"><Pnumber>a</Pnumber><P3para><Text>A, unless it would not be appropriate to do so, having regard to A’s age and understanding,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/3/b" id="regulation-5-3-b"><Pnumber>b</Pnumber><P3para><Text>any parent of A’s and any person who is not A’s parent but who has parental responsibility<FootnoteRef Ref="f00009"/> for A unless to do so would place A at risk of significant harm,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/3/c" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/3/c" id="regulation-5-3-c"><Pnumber>c</Pnumber><P3para><Text>where different from the responsible local authority, the local authority in whose area A is accommodated, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2011/1010/regulation/5/3/d" IdURI="http://www.legislation.gov.uk/id/uksi/2011/1010/regulation/5/3/d" id="regulation-5-3-d"><Pnumber>d</Pnumber><P3para><Text>any other person with responsibility for safeguarding and promoting A’s welfare under the 1989 Act <Addition ChangeId="key-165262d9f8aafb7f3158016344bd706a-1785942214122" CommentaryRef="key-165262d9f8aafb7f3158016344bd706a">or, as the case may be, the Social Services and Well-being (Wales) Act 2014</Addition>.</Text></P3para></P3></P2para></P2></P1para></P1></P1group>

<Title>EXPLANATORY NOTE</Title>

</Comment>
<P><Text>These Regulations<Character Name="NonBreakingSpace"/>are made under section 86A of the Children Act 1989, which imposes a duty on local authorities to make arrangements for children in long-term residential care to be visited by a representative of the authority. Section 86A of that Act is a new provision which was inserted by section 18 of the Children and Young Persons Act 2008.</Text></P>
<P><Text>Regulation 3 prescribes the frequency with which a representative of the authority must visit the accommodated child.</Text></P>
<P><Text>Regulation 4 requires the representative of the authority to speak to the accommodated child in private during each visit, unless it would be inappropriate to do so.</Text></P>
<P><Text>Regulation 5 requires the representative to prepare a report of each visit. It also sets out the contents of the report and the persons to whom the local authority must give a copy.</Text></P>
<P><Text>A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.</Text></P>
