The Secretary of State, in exercise of the powers conferred by section 166(3) of, and paragraphs 1 and 3(a) of Schedule 8 to, the Immigration and Asylum Act 1999(1), makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Asylum Support (Amendment) Regulations 2010 and shall come into force on the 12th April 2010.

Kind and levels of support for essential living needs

2.  For the table at regulation 10(2) of the Asylum Support Regulations 2000(2) substitute -

Single person aged 25 or over (where the decision to grant support was made prior to the 5th October 2009 and the person reached age 25 prior to that date)£42.62
Any other single person aged 18 or over£35.52
Person aged at least 16 but under 18 (except a member of a qualifying couple)£38.60
Person aged under 16£51.37.

Revocation of the Asylum Support (Amendment) (No. 2) Regulations 2009

3.  The Asylum Support (Amendment) (No. 2) Regulations 2009 are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Regulation 2 amends regulation 10(2) of the Asylum Support Regulations 2000 by increasing the cash amounts payable, as a general rule, in respect of a person’s essential living needs. These changes take effect from the 12th April 2010 and on that date the Asylum Support (Amendment) (No.2) Regulations 2009, which set out the amounts previously payable, are revoked.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
