The Volatile Organic Compounds in Paints, Varnishes and Vehicle Refinishing Products (Amendment) Regulations 2010

The Secretary of State, having been designated in relation to the environment(1), makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(2).

Citation and commencement

1.  These Regulations may be cited as the Volatile Organic Compounds in Paints, Varnishes and Vehicle Refinishing Products (Amendment) Regulations 2010 and they come into force on 1st June 2010.

Amendments to the Volatile Organic Compounds in Paints, Varnishes and Vehicle Refinishing Products Regulations 2005

2.—(1) The Volatile Organic Compounds in Paints, Varnishes and Vehicle Refinishing Products Regulations 2005(3) are amended as follows.

(2) In paragraph 2(3) of Schedule 1—

(a)in the definition of “coating” for ‘preparation’ substitute ‘mixture’,

(b)after the definition of “film”, insert—

mixture” means mixtures or solutions composed of two or more substances.,

(c)omit the definition of “preparation”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Volatile Organic Compounds in Paints, Varnishes and Vehicle Refinishing Products Regulations 2005 (S.I. 2005/2773) which implement Directive 2004/42/EC of the European Parliament and of the Council on the limitation of emissions of volatile organic compounds due to the use of organic solvents in certain paints, varnishes and vehicle refinishing products and amending Directive 1999/13/EC.

The amendments are to implement amendments to Directive 2004/42 made by Directive 2008/112/EC of the European Parliament and of the Council of 16 December 2008 amending Council Directive 76/768/EEC, 88/378/EEC, 1999/13/EC and Directives 2000/53/EC, 2002/96/EC and 2004/42/EC of the European Parliament and of the Council in order to adapt them to Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures. The aim of Directive 2008/112/EC is to incorporate into Community legislation, criteria for the classification and labelling of substances and mixtures provided for by the Globally Harmonised System of Classification and Labelling of Chemicals.

A full regulatory impact assessment was produced in relation to the Volatile Organic Compounds in Paints, Varnishes and Vehicle Refinishing Products Regulations 2005 and a further impact assessment has not been produced for this instrument as no further impact on business, the private or voluntary sectors is foreseen.
