EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Child Trust Funds Regulations 2004 (S.I. 2004/1450). The principal effect of these Regulations is to make technical amendments to the rules relating to (a) a person becoming the registered contact for a child’s account in adoption or guardianship cases and (b) account providers passing information to their successor where there is a change of account provider. These Regulations also up-date various statutory references in the principal Regulations.

Regulation 1 provides for citation and commencement, and regulation 2 for amendment of the principal Regulations.

Regulation 6 makes provision that, on a change of registered contact for an account, the consent of the previous registered contact is not required in adoption or guardianship cases.

Regulation 11 makes provision for account providers, on a transfer of an account, to pass on information about subscriptions to the account which have not already been reported to HMRC.

Regulation 14 provides a special valuation rule (applicable from 2020) for the reporting of the market value of the investments in an account for the year in which a child becomes 18.

Regulation 15 revises the information which local authorities are required to report for “looked after” children, if the child is (or may be) subject to immigration controls.

The remaining regulations make technical changes to the principal Regulations.

An Impact Assessment has not been produced for this instrument as it has no impact on charities and voluntary bodies, and a negligible impact on business.
