The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 29(3) and 569(4) of the Education Act 1996(1), section 19 of the Education Act 1997(2) and sections 102 and 120 of the Education Act 2005(3).

Citation and commencement

1.  These Regulations may be cited as the Education (Local Authority and School Performance Targets) (Revocation and Amendment) (England) Regulations 2010 and come into force on 30th January 2011.

Revocation

2.  The Regulations listed in the first column of the Schedule are revoked to the extent set out in the third column.

Amendment of the Education (School Performance Targets) (England) Regulations 2004

3.—(1) The Education (School Performance Targets) (England) Regulations 2004(4) are amended as follows.

(2) In regulation 8 (provision of information on performance targets to local authorities), omit “4,”.

(3) After regulation 8 insert—

Provision of information on school performance targets to the Secretary of State

8A.  A local authority shall send to the Secretary of State a list of the targets provided by the governing body of each school in their area under regulation 8 by no later than 31st January in the relevant school year..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations revoke the Regulations listed in the Schedule to the extent set out in the Schedule and amend the Education (School Performance Targets) (England) Regulations 2004 (“the 2004 Regulations”).

Regulation 2 revokes the Education (Local Authority Performance Targets) (England) Regulations 2005 (“the 2005 Regulations”).

The 2005 Regulations (as amended) require local authorities to set annual targets for the educational performance of children at maintained schools. Local authorities are required to set targets relating to achievement and progression in both English and mathematics at the end of the second key stage. In addition, local authorities are required to set performance and progression targets for pupils in the fourth key stage. Targets must also be set in relation to absence, children eligible to receive free school meals, looked after children and specified ethnic groups. Targets are also required where there is underperformance within specified ethnic groups.

The 2005 Regulations have been amended by the Education (Local Authority Performance Targets) (England) (Amendment) Regulations 2006, the Education (Local Authority Performance Targets) (England) (Amendment) Regulations 2007, the Education (School and Local Authority Performance Targets) (England) (Amendment) Regulations 2008 and the Education (School and Local Authority Performance Targets) (England) (Amendment) Regulations 2009. These amending Regulations are revoked to the extent set out in the Schedule.

Regulation 3 inserts new regulation 8A into the 2004 Regulations imposing a requirement on local authorities to provide a list of school targets to the Secretary of State by 31st January in the relevant school year. This replaces the duty imposed under regulation 5 of the 2005 Regulations. Regulation 3 also makes a minor amendment to regulation 8 of the 2004 Regulations, omitting an incorrect reference to regulation 4.

No impact assessment has been produced for this instrument because no impact on the private, voluntary or public sector is foreseen.
