In pursuance of section 2 of the Ecclesiastical Offices (Terms of Service) Measure(1), the Archbishops’ Council makes the following Regulations:

Citation and coming into force

1.  These Regulations may be cited as the Ecclesiastical Offices (Terms of Service) (Amendment) (No.2) Regulations 2010 and shall come into force on 31st January 2011.

Exclusion of offices held in pursuance of contracts of employment

2.  Regulation 2 of the Ecclesiastical Offices (Terms of Service) Regulations 2009(2) shall be amended as follows—

(a)in paragraph (2), at the beginning there shall be inserted the words “Subject to paragraph (3) below,”; and

(b)after paragraph (2) there shall be added the following paragraph—

(3) Where an office holder holds an office in pursuance of a contract of employment, these Regulations shall not apply to the office holder in respect of that office, without prejudice to the application of the Regulations in respect of any other office held by that office holder..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Ecclesiastical Offices (Terms of Service) Regulations 2009 so as to disapply the Regulations in respect of an office held by an office holder in pursuance of a contract of employment. The Regulations will continue to apply in respect of any other office held by the office holder.
