The Housing (Codes of Management Practice) (Student Accommodation) (England) Order 2010

Coming into force
The Secretary of State makes the following Order in exercise of the powers conferred by sections 233(1) and (4) and 250 of the Housing Act 20041.
He has taken reasonable steps to consult the persons mentioned in section 233(2)(a) and (b) of that Act and is satisfied as to publication arrangements as required by section 233(3) of that Act.
Citation, commencement, application and interpretation1

This Order may be cited as the Housing (Codes of Management Practice) (Student Accommodation) (England) Order 2010 and come into force on 25th November 2010.

This Order shall apply in relation to premises in England only.

In this Order, “the Act” means the Housing Act 2004.
Approval of code of practice2
The code of practice entitled the Universities UK/Guild HE Code of Practice for the Management of Student Housing, which is dated 17th August 20102 and which lays down standards of conduct and practice to be followed with regard to the management of living accommodation comprised in buildings falling within paragraph 4 of Schedule 14 to the Act (buildings occupied by students)3, is approved for the purposes of section 233 of the Act (approval of codes of practice with regard to the management of HMOsetc).
Withdrawal of approval of code of practice3
The approval of the code of practice entitled the Universities UK/Standing Conference of Principals Code of Practice for the Management of Student Housing and dated 20th February 20064 is withdrawn.
Revocations and Savings4

Subject to paragraph (2)—
a
the Housing (Approval of Codes of Management Practice) (Student Accommodation) (England) Order 20065 (“the 2006 Order”); and
b
the Housing (Approval of a Code of Management Practice) (Student Accommodation) (England) Order 20086 (“the 2008 Order”),
are revoked.

The following codes of practice7 continue to be approved for the purposes of section 233 of the Act—
a
the Accreditation Network UK/Unipol Code of Standards for Larger Developments for Student Accommodation Not Managed and Controlled by Educational Establishments, dated 20th February 2006 and approved by the 2006 Order; and
b
the ANUK/Unipol Code of Standards for Larger Developments for Student Accommodation Managed and Controlled by Educational Establishments, dated 28th August 2008 and approved by the 2008 Order.
