Coming into force

The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 3(2)(b) and (3)(b) of the Safeguarding Vulnerable Groups Act 20061:

Citation and commencement1

This Order may be cited as the Safeguarding Vulnerable Groups Act 2006 (Specified Lists: Scotland) Order 2010 and comes into force on 30th November 2010.

Barred lists2

For the purposes of—

a

section 3(2)(b) of the Safeguarding Vulnerable Groups Act 2006, the list maintained under section 1(1)(a) of the Protection of Vulnerable Groups (Scotland) Act 20072 is specified as a list corresponding to the children’s barred list;

b

section 3(3)(b) of the Safeguarding Vulnerable Groups Act 2006, the list maintained under section 1(1)(b) of the Protection of Vulnerable Groups (Scotland) Act 2007 is specified as a list corresponding to the adults’ barred list.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under the Safeguarding Vulnerable Groups Act 2006 (“the Act”). Article 2 of the Order specifies that the children’s list and the adults’ list maintained by the Scottish Ministers under the Protection of Vulnerable Groups (Scotland) Act 2007 correspond respectively to the children’s barred list and the adults’ barred list maintained under the Act. Section 3 of the Act provides that a person included in a specified list is barred under from regulated activity (as defined in Schedule 4 to the Act) relating to the relevant group.

An impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
