Coming into operation

The Secretary of State has been designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to measures relating to basic safety standards for health protection of the general public and workers against the dangers of ionising radiation.

The Secretary of State makes the following Regulations in exercise of the powers conferred by that section:

Citation and commencement1

These Regulations may be cited as the Radioactive Contaminated Land Regulations (Northern Ireland) (Amendment) Regulations 2010 and come into operation on 30th September 2010.

The Radioactive Contaminated Land Regulations (Northern Ireland) 20063 are amended as follows.

In paragraph (2) of regulation 2 for the definition of “substance” substitute—

  • “substance” means, whether in solid or liquid form or in the form of a gas or vapour, any substance containing radionuclides which have resulted from the after-effects of a radiological emergency or have been processed as part of a past practice or past work activity;

EXPLANATORY NOTE

These Regulations further amend the Radioactive Contaminated Land Regulations (Northern Ireland) 2006 (S.R. (NI) 2006 No 345). The amendments made by these Regulations substitute a new definition of “substance” for the purposes of the Radioactive Contaminated Land Regulations (Northern Ireland) 2006.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
