The Education (Individual Pupil Information) (Prescribed Persons) (England) (Amendment) Regulations 2010

The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 537A(4), (5) and (6) and 569(4) of the Education Act 1996(1).

Citation, commencement and application

1.—(1) These Regulations may be cited as the Education (Individual Pupil Information) (Prescribed Persons) (England) (Amendment) Regulations 2010 and come into force on 1st September 2010.

(2) These Regulations apply to individual pupil information relating to pupils at schools in England only.

Amendment of the Education (Individual Pupil Information) (Prescribed Persons) (England) Regulations 2009

2.—(1) The Education (Individual Pupil Information) (Prescribed Persons) (England) Regulations 2009(2) are amended as follows.

(2) In regulation 2(1) (interpretation) for the definition of “the relevant school” substitute—

“the relevant school” means the school at which the relevant pupil is or was registered and, where the school at which the relevant pupil was registered is converted into an Academy (as described in section 4(3) of the Academies Act 2010 (c. 32)), includes that Academy..

(3) In regulation 3(5)(e) (prescribed persons) after “governing body” insert “or proprietor”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Individual Pupil Information) (Prescribed Persons) (England) Regulations 2009 so as to enable individual pupil information to be disclosed to the proprietor of an Academy where the school at which the pupil to whom the information relates was registered is converted into an Academy (as described in section 4(3) of the Academies Act 2010).

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. The impact on the public sector is minimal.
