The Secretary of State for Education makes the following Regulations in the exercise of powers conferred by section 569(4) of, and paragraph 3 of Schedule 1 to, the Education Act 1996(1).
1. These Regulations may be cited as the Education (Pupil Referral Units) (Application of Enactments) (England) (Amendment) (No. 2) Regulations 2010 and come into force on 1st September 2010.
2. In Part 1 of Schedule 1 to the Education (Pupil Referral Units) (Application of Enactments) (England) Regulations 2007(2) omit—
(a)paragraph 20A and its heading;
(b)paragraph 23A and its heading.
3. The Education (Pupil Referral Units) (Application of Enactments) (England) (Amendment) Regulations 2010(3) are revoked.

These Regulations amend the Education (Pupil Referral Units) (Application of Enactments) (England) Regulations 2007 to omit paragraphs 20A and 23A of Part 1 of Schedule 1 which were inserted by the Education (Pupil Referral Units) (Application of Enactments) (England) (Amendment) Regulations 2010. They applied section 10 of the Children Act 2004 (as amended by section 193 of the Apprenticeships, Skills, Children and Learning Act 2009) (children’s trusts) and section 248 of the Apprenticeships, Skills, Children and Learning Act 2009(duty of co-operation with a view to promoting good behaviour) to pupil referral units as they apply to maintained schools with modifications. Section 10 of the Children Act 2004 (as amended) is no longer to apply to pupil referral units from 1 September 2010 and section 248 of the Apprenticeships, Skills, Children and Learning Act 2009 is not now to come into force on 1 September 2010 and for that reason will not apply to maintained schools or to pupil referral units. These Regulations also revoke the Education (Pupil Referral Units) (Application of Enactments) (England) (Amendment) Regulations 2010.
