The Export Control (Iran) (Amendment) Order 2010

The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the interruption or reduction, in part or completely, of economic relations with one or more countries which are not Member States.

The Secretary of State, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 and by sections 1, 2, 3, 4, 5 and 7 of the Export Control Act 2002(3), makes the following Order:

1.  This Order may be cited as the Export Control (Iran) (Amendment) Order 2010 and shall come into force on 29th January 2010.

2.  In article 1(2) of the Export Control (Iran) Order 2007(4)—

(a)in the definition of “CML items”, for “(2007/197/CFSP)” substitute “(OJ No C 65, 19.3.2009, p1)”;

(b)for the definition of “the Regulation” substitute—

“the Regulation” means Council Regulation (EC) No 423/2007(5) as last amended by Council Regulation (EU) No 1228/2009(6).

EXPLANATORY NOTE

(This note is not part of the Order)

The Export Control (Iran) Order 2007 contains provisions to give effect to Council Regulation (EC) No 423/2007 concerning restrictive measures against Iran. This Order amends the 2007 Order to take account of amendments to the 2007 Regulation, principally affecting Annexes IA and II which list items that are subject to restrictions. It also takes the opportunity to update the reference in the 2007 Order to the Common Military List of the European Union.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
