By the Lords of Her Majesty’s Most Honourable Privy Council

Their Lordships make the following Order of Council in exercise of the powers conferred by article 1(4) of the Medical Profession (Miscellaneous Amendments) Order 2008(1):

Citation and interpretation

1.—(1) This Order may be cited as the Medical Profession (Miscellaneous Amendments) Order 2008 (Commencement No. 3) Order of Council 2010.

(2) In this Order, “the Order” means the Medical Professional (Miscellaneous Amendments) Order 2008.

Appointed day

2.  30th April 2010 is the day appointed for the coming into force of the following provisions of the Order—

(a)the following paragraphs of Part 2 of Schedule 1—

(i)paragraph 13, except in so far as it inserts sub-paragraph (b) of section 29EA(1) and the word “or” immediately before that provision;

(ii)paragraph 17;

(b)article 3(2) in so far as it relates to the provisions of the Order mentioned in paragraph (a) of this article.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order appoints 30th April 2010 as the day on which certain provisions of the Medical Profession (Miscellaneous Amendments) Order 2008 (“the 2008 Order”) are to come into force. These provisions amend the Medical Act 1983 and relate to the disclosure of information obtained by a licensing authority about a medical practitioner during a revalidation pilot scheme, and the use of such information in investigation proceedings. Paragraph 13 of Schedule 1, Part 2 of the 2008 Order inserts section 29EA into the Medical Act 1983; and paragraph 17 of that Part amends section 35C of the Act.
