This Order is made in exercise of the powers conferred by paragraphs 8(1) of Schedule 8 and 3(1) of Schedule 10 to the Traffic Management Act 2004(1).

Staffordshire County Council has applied to the Secretary of State for an order to be made under these powers in respect of part of its area.

The Secretary of State has consulted the Chief Constable of the Staffordshire Constabulary in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.

Accordingly, the Secretary of State for Transport(2) makes this Order.

Citation and commencement

1.  This Order may be cited as the Civil Enforcement of Parking Contraventions (County of Staffordshire) (Districts of Cannock Chase, Lichfield, South Staffordshire and Tamworth) Designation Order 2009 and shall come into force on 23rd March 2009.

Designation of civil enforcement area and special enforcement area

2.  The Secretary of State designates the area described in the Schedule as—

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

SCHEDULEArea designated as a civil enforcement area for parking contraventions and a special enforcement area

This Order applies to the area of the Districts of Cannock Chase, Lichfield, South Staffordshire and Tamworth in the County of Staffordshire except—

(a)in the area of the District of Cannock Chase-

(i)the A5 from the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ966092) to its junction with the A4601 (at Ordnance Survey National Grid reference point SJ968091),

(ii)the A5 from the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ990081) to the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ994080),

(iii)the A5 from the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ999077) to the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SK031065),

(iv)the M6 Toll, including on and off slip roads, from the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ981082) to the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ982082), and

(v)the M6 Toll, including on and off slip roads, from the boundary of the District of South Staffordshire (at Ordnance Survey National Grid reference point SJ988083) to the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SK031072);

(b)in the area of the District of Lichfield–

(i)the M6 Toll, including on and off slip roads, from the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SK033071) to the boundary of the City of Birmingham (at Ordnance Survey National Grid reference point SK138002),

(ii)the A5, including on and off slip roads, from the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SK051065) to the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SK054065),

(iii)the A5, including on and off slip roads, from the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SK061065) to the boundary of the Borough of Tamworth (at Ordnance Survey National Grid reference point SK197030),

(iv)the A38, including on and off slip roads, from the boundary of the Borough of North Warwickshire (at Ordnance Survey National Grid reference point SP148991) to the boundary of the Borough of East Staffordshire (at Ordnance Survey National Grid reference point SK183158), and

(v)the A5148, including on and off slip roads, from its junction with the A5 (at Ordnance Survey National Grid reference point SK113058) to its junction with the A38 (at Ordnance Survey National Grid reference point SK129079);

(c)in the area of the District of South Staffordshire-

(i)the M54, including on and off slip roads, from the boundary of the District of Bridgenorth (at Ordnance Survey National Grid reference point SJ842057) to its junction with the M6 (at Ordnance Survey National Grid reference point SJ972031),

(ii)the M6, including on and off slip roads, from the boundary of the Borough of Stafford (at Ordnance Survey National Grid reference point SJ924191) to the boundary of the Metropolitan Borough of Walsall (at Ordnance Survey National Grid reference point SJ981021),

(iii)the M6 Toll, including on and off slip roads, from its junction with the M6 (at Ordnance Survey National Grid reference point SJ947084) to the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ981082),

(iv)the M6 Toll, including on and off slip roads, from the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ982082) to the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ988083),

(v)the A5, including on and off slip roads, from Gailey Island (at Ordnance Survey National Grid reference point SJ912106) to the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ966092),

(vi)the A5 from its junction with the M6 Toll (at Ordnance Survey National Grid reference point SJ988083) to the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ990081),

(vii)the A5 from the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ994080) to the boundary of the District of Cannock Chase (at Ordnance Survey National Grid reference point SJ999077), and

(viii)the A449, including on and off slip roads, from Gailey Island (at Ordnance Survey National Grid reference point SJ912106) to the boundary of the City of Wolverhampton (at Ordnance Survey National Grid reference point SJ916044); and

(d)In the area of the Borough of Tamworth - the A5, including on and off slip roads, from the boundary of the District of Lichfield (at Ordnance Survey National Grid reference point SK197030) to the boundary of the Borough of North Warwickshire (at Ordnance Survey National Grid reference point SK242007).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the area described in the Schedule as a civil enforcement area in respect of parking contraventions, and as a special enforcement area, for the purposes of Part 6 of the Traffic Management Act 2004.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

The Secretary of State is the “appropriate national authority” for England for the purposes of Part 6 of the Traffic Management Act 2004 under section 92 of that Act.
