The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 8 and 181 of the Education and Inspections Act 2006(1).

Citation and commencement

1.  These Regulations may be cited as the School Organisation (Establishment and Discontinuance of Schools)(England)(Amendment) Regulations 2009 and come into force on 16th December 2009.

Amendment of the School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007

2.  The School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007(2) are amended as follows.

3.  In regulation 2 omit the definition of “APA rating”.

4.  In regulation 9—

(a)in each of paragraphs (1), (2)(a) and (b) and (5) for “APA” substitute “performance”;

(b)after paragraph (6) insert—

(7) In this regulation “current performance rating” means the most recent rating awarded to the authority under section 138(3) of the Act..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These regulations amend the School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007. They replace references to the “APA” (that is the Annual Performance Assessment) rating with references to a performance rating. These amendments reflect new arrangements whereby the annual performance rating of local authorities made by Her Majesty’s Chief Inspector of Education, Children’s Services and Skills under section 138(3) of the Education and Inspections Act 2006 will no longer be known as an APA but will be an element of a new Comprehensive Area Assessment.
