The Nursing and Midwifery Council has made the Nursing and Midwifery Council (Midwifery and Practice Committees) (Constitution) (Amendment) Rules 2009 as set out in the Schedule to this Order, in exercise of the powers conferred by article 3(17) of, and paragraph 17(1)(a) of Schedule 1 to, the Nursing and Midwifery Order 2001(1) and having consulted representatives of those groups of persons who appear likely to be affected by the proposed rules in accordance with article 47(3) of that Order.

In accordance with articles 47(1) and 48(1) of the Nursing and Midwifery Order 2001(2), such Rules shall not come into force until approved by Order of the Privy Council.

Having considered the Rules, their Lordships are pleased to and do approve them.

This Order may be cited as the Nursing and Midwifery Council (Midwifery and Practice Committees) (Constitution) (Amendment) Rules Order of Council 2009 and shall come into force on 23rd November 2009.

SCHEDULETHE NURSING AND MIDWIFERY COUNCIL (MIDWIFERY AND PRACTICE COMMITTEES) (CONSTITUTION) (AMENDMENT) RULES 2009

The Nursing and Midwifery Council makes the following Rules in exercise of its powers conferred under article 3(17) of, and paragraph 17(1)(a) of Schedule 1 to, the Nursing and Midwifery Order 2001.

The Nursing and Midwifery Council has consulted representatives of those groups of persons who appear likely to be affected by the proposed rules in accordance with article 47(3) of that Order.

Citation and commencement

1.  These Rules may be cited as the Nursing and Midwifery Council (Midwifery and Practice Committees) (Constitution) (Amendment) Rules 2009 and come into force on 23rd November 2009.

Amendments

2.  In the Nursing and Midwifery Council (Midwifery and Practice Committees) (Constitution) Rules Order of Council 2008 (3), in rule 6 (The Practice Committees)—

(a)in paragraph (1)(a) (which relates to the Investigating Committee), for “60” substitute “180”; and

(b)in paragraph (1)(c) (which relates to the Health Committee), for “50” substitute “120”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order approves Rules made under the Nursing and Midwifery Order 2001 (as amended, in particular by the Nursing and Midwifery (Amendment) Order 2008). These Rules amend the Nursing and Midwifery Council (Midwifery and Practice Committees) (Constitution) Rules Order of Council 2008.

The amendments increase the maximum number of persons allowed to comprise the Investigating Committee and the Health Committee from 60 to 180 and from 50 to 120 respectively.
