The Borders, Citizenship and Immigration Act 2009 (Commencement No. 1) Order 2009

The Secretary of State, in exercise of the powers conferred by sections 58(2), 58(3)(b), 58(4)(b) and 58(5) of the Borders, Citizenship and Immigration Act 2009(1), makes the following Order.

Citation and interpretation

1.—(1) This Order may be cited as the Borders, Citizenship and Immigration Act 2009 (Commencement No. 1) Order 2009.

(2) In this Order “the 2009 Act” means the Borders, Citizenship and Immigration Act 2009.

Commencement

2.  The following provisions of the 2009 Act shall come into force on 2nd November 2009—

(a)section 55 (Duty regarding the welfare of children);

(b)section 56 (Repeals) in so far as it relates to the Part of the Schedule to the 2009 Act mentioned in sub-paragraph (c); and

(c)Part 4 (Miscellaneous) of the Schedule to the 2009 Act.

3.  The following provisions of the 2009 Act shall come into force on 10th November 2009—

(a)section 51 (Fingerprinting of foreign criminals liable to automatic deportation); and

(b)section 54 (Trafficking people for exploitation).

4.  The following provisions of the 2009 Act shall come into force on 13th January 2010—

(a)section 42 (Children born in UK etc to members of the armed forces);

(b)section 43 (Minors);

(c)section 44 (British Nationals (Overseas) without other citizenship);

(d)section 45 (Descent through the female line);

(e)section 46 (Children born outside UK etc to members of the armed forces);

(f)section 47 (Good character requirement);

(g)section 48 (Meaning of references to being in breach of immigration laws);

(h)section 49(1) (Other interpretation etc);

(i)section 56 (Repeals) in so far as it relates to the Part of the Schedule to the 2009 Act in sub-paragraph (j); and

(j)Part 2 (Citizenship) of the Schedule to the 2009 Act other than the repeals to Schedule 1 British Nationality Act 1981(2).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force provisions of the Borders, Citizenship and Immigration Act 2009 (“the 2009 Act”). Section 55 of the 2009 Act is brought into force on 2nd November 2009. The provisions specified in article 3 are brought into force on 10th November 2010. The provisions specified in article 4 are brought into force on 13th January 2010.
