The Secretary of State, in exercise of the powers conferred by sections 1 and 7 of the Export Control Act 2002(1), makes the following Order:
1. This Order may be cited as the Export Control (Amendment) (No. 2) Order 2009 and shall come into force on 14th July 2009.
2. After article 9 of the Export Control Order 2008(2) insert—
9A. To the extent that, pursuant to any of articles 3 to 9 of this Order, a person may not export goods, the exportation of the goods in question is prohibited.”.

This Order clarifies the scope of the prohibitions on exportation of goods in the Export Control Order 2008 so as to ensure that breaches of the controls created by the Order are amenable to action under the Customs and Excise Management Act 1979.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
