The Police and Justice Act 2006 (Commencement No. 8) Order 2008

The Secretary of State makes the following Order in exercise of the powers conferred by section 53(1) of the Police and Justice Act 2006(1).

Citation and Extent

1.—(1) This Order may be cited as the Police and Justice Act 2006 (Commencement No. 8) Order 2008.

(2) Article 2 of this Order extends to England and Wales only.

(3) Article 3 of this Order extends to Northern Ireland only.

Commencement

2.  The following provisions of the Police and Justice Act 2006 shall come into force on 1 April 2008—

(a)Section 2 (amendments to the Police Act 1996(2)) in so far as it relates to the entries in Schedule 2 (amendments to the Police Act 1996) referred to in sub–paragraph (b);

(b)Paragraph 7 to the extent not otherwise commenced and paragraphs 11 to 13 of Schedule 2;

(c)Section 39 (forfeiture of indecent photographs of children: England and Wales) and Schedule 11 (Schedule to be inserted into the Protection of Children Act 1978);

(d)Section 52 (amendments and repeals) in so far as it relates to the entries in Schedule 15 (repeals and revocations) referred to in sub–paragraph (e);

(e)In Part 4 of Schedule 15 (repeals: miscellaneous) the entries relating to section 4(3) of the Protection of Children Act 1978(3), paragraph 62 of Schedule 15 to the Criminal Justice Act 1988(4), sub–paragraphs 37(4) and 38(3) and 4 of Schedule 10 to the Criminal Justice and Public Order Act 1994(5) and paragraphs 199(3) and 200 to Schedule 8 of the Courts Act 2003(6).

3.  The following provisions of the Police and Justice Act 2006 shall come into force on 1 April 2008—

(a)Section 40 (forfeiture of indecent photographs of children: Northern Ireland) and Schedule 12 (Schedule to be inserted into the Protection of Children (Northern Ireland) Order 1978);

(b)Section 52 (amendments and repeals) in so far as it relates to entries in Schedule 15 (repeals and revocations) referred to in sub-paragraph (c);

(c)In Part 4 of Schedule 15 (repeals: miscellaneous) the entries relating to sub–paragraph 1(2) of Schedule 2 to the Criminal Justice (Evidence, etc.) (Northern Ireland) Order 1988(7), sub–paragraph 10(2)(b) and (c) of Schedule 2 to the Criminal Justice and Police Act 2001(8) and sub–paragraph 3(2)(a) of Schedule 4 to the Justice (Northern Ireland) Act 2002(9).
