The Crime and Disorder Act 1998 (Additional Authorities) Order 2008

Coming into force

The Secretary of State makes the following Order in exercise of the powers conferred by section 17(4) of the Crime and Disorder Act 19981.

In accordance with section 114(3)2 of that Act a draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament.

Citation and commencement1

This Order may be cited as the Crime and Disorder Act 1998 (Additional Authorities) Order 2008 and shall come into force one month after the day on which it is made.

In section 17(2) of the Crime and Disorder Act 19983 (duty to consider crime and disorder implications), at the end of subsection (2) (authorities to which the duty applies) there is inserted —

the Greater London Authority4;

the London Development Agency5.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the list of authorities in section 17(2) of the Crime and Disorder Act 1998 to which the duty in section 17(1) applies. The duty in section 17(1) is a duty to exercise functions with regard to the likely effect of those functions on, and the need to do all that a body or person reasonably can to prevent, crime and disorder (including anti-social behaviour and behaviour adversely affecting the local environment) in the area and the misuse of drugs, alcohol and other substances in the area. The bodies added are the Greater London Authority, the London Development Agency and Transport for London.
