The Greater London Authority (Limitation of Salaries) (Amendment) Order 2008

The Secretary of State for Communities and Local Government makes the following Order in exercise of the powers conferred by sections 25 and 420(1) of the Greater London Authority Act 1999(1):

Citation and commencement

1.  This Order may be cited as the Greater London Authority (Limitation of Salaries) (Amendment) Order 2008 and shall come into force on 1st May 2008.

Limit on salaries of Authority members

2.—(1) The Greater London Authority (Limitation of Salaries) Order 2000(2) is amended as follows.

(2) For article 3, substitute—

Limit on salaries of Authority members

3.  If relevant remuneration is payable to a person who is the Mayor or an Assembly member, the amount of any salary which would, but for the provisions of this Order, be payable to that person under section 24 of the Greater London Authority Act 1999 shall—

(a)in relation to a term of office (as the Mayor or an Assembly member) which begins before 1st May 2008, be reduced to two thirds of what it would otherwise be;

(b)in relation to a term of office (as the Mayor or an Assembly member) which begins on or after 1st May 2008, be reduced to one third of what it would otherwise be..

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Greater London Authority (Limitation of Salaries) Order 2000 (“the 2000 Order”).

Article 2 of this Order substitutes a new article 3 of the 2000 Order. This provides that, in relation to a term of office which begins on or after 1st May 2008, the salary otherwise payable to the Mayor of London or an Assembly member of the Greater London Authority must be reduced by two thirds if a salary, payable by virtue of membership of either House of Parliament or of the European Parliament, (“relevant remuneration”) is also payable to that person.

The existing limit on salaries, whereby a salary otherwise payable to the Mayor of London or an Assembly member must be reduced by one third, if relevant remuneration is also payable to that person, continues to apply in relation to a term of office which begins before 1st May 2008.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
