The Secretary of State, in exercise of the powers conferred by section 51 of the Police and Justice Act 2006(1), makes the following Order.
1.—(1) This Order may be cited as the Police and Justice Act 2006 (Supplementary and Transitional Provisions) (Amendment) Order 2008 and shall come into force on 30th March 2008.
2.—(1) The Police and Justice Act 2006 (Supplementary and Transitional Provisions) Order 2006(2) is amended as follows.
(2) In article 2(2) for “be extended to 31st March” substitute “expire on 30th September”.
(3) In article 3(2) for “be extended to 2nd July” substitute “expire on 30th September”.
(4) After article 3(2) insert
“(3) Notwithstanding that, in accordance with paragraphs 10 and 11 of current Schedule 2A to the 1996 Act, the term of appointment of a person appointed to be a member of the Metropolitan Police Authority under paragraph 3 of that Schedule expires on or after 2nd July 2008 but before 30th September 2008, that appointment shall be expire on 30th September 2008.”.

This Order amends the Police and Justice Act (Supplementary and Transitional Provisions) Order 2006. That Order together with the Police and Justice Act 2006 (Commencement No. 1, Transitional and Saving Provisions) Order 2006 made supplementary and transitional provision related to the bringing into force of paragraphs 1 to 6 of Schedule 2 to the Police and Justice Act 2006 that introduced a new regime for the membership of police authorities.
The earlier orders ensured that the existing provisions of the Police Act 1996 concerning police authority membership would continue until 1st April 2008 for police authorities other than the Metropolitan Police Authority and until 3rd July 2008 for the Metropolitan Police Authority. This Order and an Order amending the Police and Justice Act 2006 (Commencement No. 1, Transitional and Saving Provisions) Order 2006 amend those transitional and savings provisions so that the previous provisions continue to apply to appointments that take effect before 1st October 2008 for all police authorities. In particular this Order provides that existing independent members of the Metropolitan Police Authority whose appointments would otherwise expire between 2nd July 2008 and 30th September 2008 will be extended to 30th September 2008.
