<Text>The Postgraduate Medical Education and Training Board has made the Postgraduate Medical Education and Training Board (Fees) Rules 2008 (“the Rules”) as set out in the Schedule to this <Abbreviation Expansion="General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003 (S.I. 2003/1250)">Order</Abbreviation>.</Text></P>
<P>
<Text>In accordance with article 25(2) of the General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003<FootnoteRef Ref="f00001"/> (“the Order”) such Rules shall not come into force until approved by the Secretary of State.</Text></P>
<P>
<Text>In accordance with article 25(2) of the Order the Secretary of State has consulted the Scottish Ministers, the Department of Health, Social Services and Public Safety in Northern Ireland and the Welsh Ministers.</Text></P>
<P>
<Text>Having considered the Rules, the Secretary of State approves them.</Text></P>

<Text>These Rules shall apply in respect of any Application or Re-submitted Application submitted to the Board on or after 1st April 2008.</Text>

<Title>Interpretation</Title>

<P2para><Text>In the Rules—</Text>
<UnorderedList Decoration="none" Class="Definition">
<ListItem>
<Para><Text>“Application” includes the processing of, and the making of a determination in respect of, the application;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“competent authority” has the meaning given to it in Schedule 1 to the Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“CCT” has the meaning given to it in Schedule 1 to the Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“the Directive” has the meaning given to it in Schedule 1 to the Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“exempt person” has the meaning given to it in Schedule 1 to the Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“General Systems Regulations” has the meaning given to it in Schedule 1 to the Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Oral Appeal” means an appeal determined after an oral hearing;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Order” means the General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Original Decision” means a decision of the Board under article 8(1), article 11(6), article 11A(2), article 14(10) or article 14A(2) which is not a Subsequent Decision;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“relevant European State” has the meaning given to it in Schedule 1 to the Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Re-submitted Application” means an application submitted by a person to the Board pursuant to—</Text>
<OrderedList Decoration="parens" Type="alpha">
<ListItem>
<Para><Text>article 8(1), where the Board has previously issued to that person an Original Decision under that article;</Text></Para>
</ListItem>
<ListItem>
<Para><Text>article 11(3), where the Board has previously issued to that person an Original Decision under article 11(6);</Text></Para>
</ListItem>
<ListItem>
<Para><Text>article 11A(1), where the Board has previously issued to that person an Original Decision under article 11A(2);</Text></Para>
</ListItem>
<ListItem>
<Para><Text>article 14(4) or (5), where the Board has previously issued to that person an Original Decision under article 14(10); or</Text></Para>
</ListItem>
<ListItem>
<Para><Text>article 14A(1), where the Board has previously issued to that person an Original Decision under 14A(2),</Text></Para>
</ListItem>
</OrderedList>
<Text>where that application is received by the Board within the period of three years beginning with the date of the Board’s Original Decision, regardless of whether that application includes a request for a statement of eligibility for registration pursuant to article 11(7) or 14(11);</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Review” means a review of—</Text>
<OrderedList Decoration="parens" Type="alpha">
<ListItem>
<Para><Text>an Original or a Subsequent Decision; or</Text></Para>
</ListItem>
<ListItem>
<Para><Text>a decision of the Board in respect of an application for a certificate of acquired rights under article 12(3) of the Order,</Text></Para>
</ListItem>
</OrderedList>
<Text>as provided for in the Postgraduate Medical Education and Training Board (Award of Certificates) Rules 2005<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Subsequent Decision” means a decision of the Board under article 8(1), article 11(6), article 11A(2), article 14(10) or article 14A(2) made pursuant to a Re-submitted Application; and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Written Appeal” means an appeal determined without an oral hearing.</Text>
</Para>
</ListItem>

<Title>Fees to be charged by the Board</Title>

<Text>In respect of each function identified in column 2 of the table in the Schedule, the Board shall charge a fee of the applicable amount set out in the corresponding entry in column 3 of that table.</Text>

<Title>EXPLANATORY NOTE</Title>

</Comment>
<P><Text>This Order, which is made under the General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003, approves rules made by the Postgraduate Medical Education and Training Board (“the Board”).</Text></P>
<P><Text>The Rules specify fees that are payable to the Board in respect of the exercise by the Board of certain functions. The functions in respect of which fees are payable include—</Text><P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>issuing Certificates of Training for general practitioners and specialists;</Text>
</P3para></P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>applications to the Board to determine whether certain persons not holding Certificates of Completion of Training have met particular standards of equivalence; and</Text>
</P3para></P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>appeals against the Board’s decisions.</Text>
</P3para></P3>
</P>
<P><Text>The fees relating to certificates of completion of training for general practitioners and specialists under articles 11 and 14 are increased by 48% and all other fees are increased by approximately 4%.</Text></P>
