The National Health Service (Dental Charges) Amendment Regulations 2008

The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 176 and 272(7) of the National Health Service Act 2006(1).

Citation, commencement and application

1.—(1) These Regulations may be cited as the National Health Service (Dental Charges) Amendment Regulations 2008 and shall come into force on 1st April 2008.

(2) These Regulations apply in relation to England.

Interpretation

2.  In these Regulations, “the Dental Charges Regulations” means the National Health Service (Dental Charges) Regulations 2005(2).

Amendment of the Dental Charges Regulations

3.—(1) The Dental Charges Regulations are amended as follows.

(2) In regulation 4 (calculation of charges)—

(a)in paragraph (1), for £15.90 substitute £16.20;

(b)in paragraph (2), for £43.60 substitute £44.60;

(c)in paragraph (3), for £194.00 substitute £198.00;

(d)in paragraph (4), for £194.00 substitute £198.00; and

(e)in paragraph (5), for £15.90 substitute £16.20.

(3) In Schedule 3 to the Dental Charges Regulations (Band 3 Charges – Provision of Appliances) for paragraph (a) substitute—

(a)laboratory fabricated porcelain or composite veneers, including acid etch   retention.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Dental Charges) Regulations 2005 (“the Dental Charges Regulations”) (S.I. 2005/3477).

Regulation 3(2) of these Regulations amends regulation 4 of the Dental Charges Regulations (calculation of charges) by increasing by approximately 2.1% the applicable charge payable for a course of treatment, if none of the exemptions from charging apply.

Regulation 3(3) amends the reference to veneers in the list of appliances for which a Band 3 charge may be made and recovered in Schedule 3 to the Dental Charges Regulations to clarify that only laboratory fabricated veneers may be used.

A full Impact Assessment has not been produced for this Instrument as it has no impact on the cost of business, charities or voluntary bodies.
