The Secretary of State, in exercise of the powers conferred by sections 1, 2, 4, 5 and 7 of the Export Control Act 20021, makes the following Order:
Citation, commencement and interpretation1

This Order may be cited as the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) (Amendment) (No. 2) Order 2008 and shall come into force on 2nd January 2009.

In this Order, “the 2003 Order” means the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 20032.
Amendments2

In Schedule 1 to the 2003 Order—
a
in paragraph g. of the note to entry ML1, after “processing” insert “(ie, using only lenses to view the target)”;
b
renumber the note to entry ML2 as “Note 1” and immediately after it insert—
Note 2: ML2.a. does not apply to hand-held projectile launchers specially designed to launch tethered projectiles, having no high explosive charge or communications link, to a range of 500m or less.
c
after entry ML6, insert a new entry PL5035 as follows—
Components that are both specially designed to provide ballistic protection and specially designed or modified for “vehicles” specified in ML6.b.
