Her Majesty, in exercise of the powers conferred upon Her by section 1 of the United Nations Act 19461, is pleased, by and with the advice of Her Privy Council, to order as follows:—

Citation, commencement and extent1

This Order may be cited as the United Nations Arms Embargoes (Dependent Territories) (Amendment) Order 2008 and shall come into force on 12th December 2008.

In this Order “the Principal Order” means the United Nations Arms Embargoes (Dependent Territories) Order 19952.

This Order shall extend to the territories listed in Schedule 1 to the Principal Order.

Amendment of the Order2

The Principal Order is amended as follows:—

In the first paragraph of the recital of powers the words “and Rwanda” shall be deleted and the word “and” shall be inserted between “Somalia” and “the former Yugoslavia”.

In Article 2 the words “or Rwanda” are omitted from the definition of “prohibited destination”.

In Article 3(1) sub-paragraphs (c)(iv) and (c)(v) shall be deleted and the word “or” shall be removed from the end of sub-paragraph (c)(iii) and a full-stop inserted.

In Article 4 paragraphs (iv) and (v) shall be deleted and the word “or” shall be removed from the end of paragraph (iii) and a full-stop inserted.

In Article 8 paragraphs (1A) and (3A) shall be deleted.

In Article 9 the words “or (1A)” which appear before the words “of article 8” in the third line of paragraphs (1), (3) and (5) shall be deleted.

In Article 9 the word “or Rwanda” shall be deleted from sub-paragraph (8)(c).

In Article 11(1) the words “or (3A)” shall be deleted.

In Schedule 3 paragraph 4, sub-paragraph (c) the words “or Rwanda” shall be deleted.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the United Nations Arms Embargoes (Dependent Territories) Order 1995 by removing the references to Rwanda in the Order to take account of the lifting of the arms embargo imposed on Rwanda by United Nations Security Resolution 918 (1994) of 17th May 1994. The arms embargo on Rwanda has been lifted following the adoption of United Nations Security Council Resolution 1823 (2008) which was adopted on 10th July 2008.

A Regulatory Impact Assessment has not been produced for this instrument as it has no impact on the costs of business, charities or voluntary bodies.
