Her Majesty, in exercise of the powers conferred upon Her by sections 8, 41, 57, 58, 59 and 61 of the Civil Aviation Act 1949(1) as extended to certain territories by the Civil Aviation Act 1949 (Overseas Territories) Order 1969(2), and as amended by section 62 of the Civil Aviation Act 1971(3), as so extended by the Civil Aviation Act 1971 (Overseas Territories) Order 1976(4) is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1. This Order may be cited as the Civil Aviation (Overseas Territories) (Gibraltar) (Revocations) Order 2008, and comes into force on such day as the Governor of Gibraltar may appoint by proclamation published in the Gibraltar Gazette.
2. The Orders set out in the Schedule which have been revoked in respect of their application to certain territories other than Gibraltar, are now also revoked in respect of their application to Gibraltar.

This Order revokes, in respect of their application to Gibraltar, the Air Navigation (Overseas Territories) Order 1989, the Air Navigation (Overseas Territories) (Amendment) Order 1991, the Air Navigation (Overseas Territories) (Amendment) (No 2) Order 1991, the Air Navigation (Overseas Territories) (Amendment) Order 1992, the Air Navigation (Overseas Territories) (Amendment) Order 1995 and the Air Navigation (Overseas Territories) (Amendment) Order 1997. These Orders were all previously revoked by the Air Navigation (Overseas Territories) Order 2001 (S.I. 2001/2128) except insofar as they applied to Gibraltar. This Order is necessary to avoid a conflict that would otherwise occur when civil aviation legislation in Gibraltar comes into force; that legislation will govern the aspects of civil aviation in Gibraltar currently covered by these Orders.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
