The Education (School Teachers’ Pay and Conditions) Order 2008

Coming into force

Following the reference to them of certain matters by the Secretary of State under section 120(1) of the Education Act 20021 (“the Act”) and after following the procedure set out in section 121 of the Act, the School Teachers’ Review Body2 (“the STRB”) have reported to the Prime Minister and the Secretary of State in accordance with section 120(3) of the Act3.

In accordance with section 120(4) of the Act the Prime Minister and the Secretary of State have arranged for the report of the STRB to be published4.

In accordance with section 125(1)(b) of the Act the Secretary of State has considered the STRB’s report, and in accordance with section 126 has consulted such of the persons and bodies referred to in that section as appeared to him to be appropriate.

The Secretary of State for Children, Schools and Families makes the following Order in exercise of the powers conferred by sections 122(1), 123 and 124 of the Act. The document to which this Order refers also makes subsidiary provision about matters which have not been referred to the STRB under section 120(1) of the Act, in reliance upon section 125(2)(a) of the Act.

Citation, commencement, application and interpretation1

This Order may be cited as the Education (School Teachers’ Pay and Conditions) Order 2008 and comes into force on 1st September 2008.

In this Order, “the Document” means the document entitled “School Teachers’ Pay and Conditions Document 2008 and Guidance on School Teachers’ Pay and Conditions” published by The Stationery Office Limited5.

The Document2

The provisions set out in section 2 of the Document have effect on and after 1st September 2008 for the purposes of determining—

a

the remuneration of school teachers, and

b

other conditions of employment of school teachers which relate to their professional duties and working time.

Revocation3

The Education (School Teachers’ Pay and Conditions) Order 20076 is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under the Education Act 2002 (“the Act”). It makes provision for the determination of the remuneration of school teachers (within the meaning of section 122 of the Act) in England and Wales and other conditions of employment of school teachers which relate to their professional duties and working time.

The Order makes this provision by reference to section 2 of a document entitled “School Teachers’ Pay and Conditions Document 2008 and Guidance on School Teachers’ Pay and Conditions” (“the Document”), which is published by The Stationery Office Limited and is obtainable from Government book shops and from booksellers. It can also be found on the internet at www.teachernet.gov.uk/pay. The Order provides that the provisions set out in section 2 of the Document have effect from 1st September 2008.

The Order revokes the Order that made such provision for school teachers by reference to section 2 of the School Teachers’ Pay and Conditions Document 2007 and Guidance on School Teachers’ Pay and Conditions.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
