Coming into force
The Secretary of State for Children, Schools and Families makes the following regulations in exercise of the powers conferred by section 3(1), (3) and (4) of the Education (Schools) Act 19971:
Citation, commencement and application1

These Regulations may be cited as the Education (Assisted Places) (Incidental Expenses) (Amendment) (England) Regulations 2008 and come into force on 1st September 2008.

These Regulations apply in relation to a school year beginning on or after that date.

These Regulations apply only in relation to England.
Amendment of the Education (Assisted Places) (Incidental Expenses) Regulations 19972

The Education (Assisted Places) (Incidental Expenses) Regulations 19972 are amended as follows.

In regulation 2—
a
in paragraph (2), for “£13,861” substitute “£14,443”;
b
in paragraph (3), for sub-paragraphs (a) and (b) substitute—
a
£90 where the relevant income does not exceed £13,397; and
b
£46 where that income exceeds £13,397, but does not exceed £14,443.

In regulation 4 —
a
in paragraph (3), for “£12,877” substitute “£13,410”; and
b
in paragraph (4)—
i
for “£12,877” substitute “£13,410”; and
ii
for “£12,698” substitute “£13,231”.
