Citation, commencement, application and extent

1.—(1) These Regulations may be cited as the Education (Student Support) (No. 2) Regulations 2008.

(2) Paragraph (1) and this paragraph, regulation 3 and Schedule 5 come into force on the 22nd day after these Regulations are laid before Parliament.

(3) The remaining provisions of these Regulations come into force on 1st September 2008.

(4) Subject to paragraphs (5) and (6), these Regulations apply in relation to England (1).

(5) Regulation 94(1) also applies in relation to Wales.

(6) Regulation 94(2) extends to Northern Ireland.

(7) These Regulations, except regulation 3 and Schedule 5, apply in relation to the provision of support to students in relation to an academic year which begins on or after 1st September 2009 whether anything done under these Regulations is done before, on or after 1st September 2009.

In relation to Wales, the functions of the Secretary of State under section 22 of the Teaching and Higher Education Act 1998 were transferred to the Welsh Ministers under section 44 of the Higher Education Act 2004 except so far as they relate to the making of any provision authorised by subsection (2)(a), (c), (j) or (k), (3)(e) or (f) or (5) of section 22.
