Representative organisations have been consulted in accordance with section 61(2) of the Public Passenger Vehicles Act 1981(4).

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Public Service Vehicles (Registration of Local Services) (Amendment) (England and Wales) Regulations 2008 and shall come into force on 1st August 2008.

(2) These regulations extend to England and Wales (5).

Amendment of the principal Regulations

2.  — The Public Service Vehicles (Registration of Local Services) Regulations 1986(6) are amended as follows.

(1) In regulation 12(1)(b), for “£54” substitute “£57”; and

(2) In regulation 12(2)(b), for “£54” substitute “£57”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations increase the fee for the registration of, or the variation of the registration of, a local bus service. The fee for a local bus service other than a community bus service is increased from £54 to £57. This represents an increase of 5.6%. The fees were last increased on 1st April 2007.

1981 c.14 (in these footnotes called “the 1981 Act”). Relevant amendments to sections 52(1)(a) and 60(1) of the 1981 Act were made by the Transport Act 1985 (c.67) (in these footnotes called “the 1985 Act”) and by the Deregulation and Contracting Out Act 1994 (c.40) (in these footnotes called “the 1994 Act”), as follows. Section 52(1)(a) of the 1981 Act was amended by paragraphs 4(1) and 4(14) of Part II of Schedule 2 of the 1985 Act; section 60(1) of the 1981 Act was amended by paragraphs 4(1) and 4(18) of Part II of Schedule 2 of the 1985 Act and words were omitted from section 60(1) of the 1981 Act by Schedule 8 of the 1985 Act. Section 52(1)(a) of the 1981 Act was further amended by section 66(2) of the 1994 Act and section 60(1) (e) of the 1981 Act was substituted by section 66(5) of the Act. Section 60(1A) of the 1981 Act was inserted by section 134(2) (b) of the 1985 Act. For the definition of “prescribed” and “regulations”, see section 60(2) of the 1981 Act, as amended by the 1985 Act. Sections 134(1) and (2)(c).

S.I. 1988/643, which was made under the Finance (No. 2) Act 1987 (c.51), section 102. The relevant entry in S.I. 1988/643 is Schedule 1, Table V, Item 3B.

By virtue of section 135 of the 1985 Act, section 61 of the 1981 Act has effect as if Part I of the 1985 Act were contained in the 1981 Act. Section 61(2) of the 1981 Act was amended by the 1985 Act, section 139(3) and Schedule 8.

Competence to make regulations in respect of Scotland has been devolved by virtue of the Scotland Act 1998 (c.46), section 53 and the Public Service Vehicles (Registration of Local Services) Regulations 1986 (S.I. 1986/1671) were revoked in relation to Scotland by S.S.I. 2001/219.
