Citation and commencement 1 These Regulations may be cited as the Motor Cars (Driving Instruction) (Amendment) Regulations 2007 and shall come into force on 2nd April 2007. Amendment of the Motor Cars (Driving Instruction) Regulations 2005 2 1 The table in regulation 17 of The Motor Cars (Driving Instruction) Regulations 2005 is amended as follows. 2 In item 1, in column 3 for “£50” substitute “£75”. 3 In item 2— a in column 2 omit “—prior to 1st April 2006” and “—on and from 1st April 2006”; b in column 3 for “£79” and “£82” substitute “£85”. 4 In item 3— a in column 2— i insert “the” between “to” and “instructional ability”, ii omit “—prior to 1st April 2006” and “—on and from 2nd April 2006”; b in column 3 for “£79” and “£82” substitute “£85”. These Regulations amend the Motor Cars (Driving Instruction) Regulations 2005 (“the Principal Regulations”).

Regulation 2(2) amends the Principal Regulations so as to require a candidate for a written examination to pay a fee of £75. This fee increase represents a percentage increase of 50%. The fees have not been increased since the Principal Regulations came into force on 10 August 2005.

Regulation 2(3) and (4) amend the Principal Regulations so as to require a candidate for a driving ability and fitness test or the instructional ability and fitness test to pay a fee of £85. This fee increase represents a percentage increase of 3.7%. The fees were last increased on 1 April 2006.

The fees in these Regulations have been set further to the Department of Transport (Fees) Order 1988 (S.I. 1988/643), relevant amending instruments are S.I. 1995/1684 and S.I. 2003/1094), which established a common pool for costs incurred in respect of the functions of the Secretary of State in relation to the register of approved driving instructors. In accordance with the terms of that Order, in setting the levels of fees further to this Order, the Secretary of State has taken into account the costs within that common pool.

These Regulations are made in conjunction with the Motor Vehicles (Driving Licences) (Amendment) Regulations 2007.
