<Text>The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972<FootnoteRef Ref="f00001"/> in relation to the common agricultural policy of the European Community<FootnoteRef Ref="f00002"/> and in relation to measures in the veterinary and phytosanitary fields for the protection of public health<FootnoteRef Ref="f00003"/>.</Text></P>

<Text>The Treasury consent to these Regulations in accordance with section 56(1) of the Finance Act 1973<FootnoteRef Ref="f00004"/>.</Text></P>

<Text>These Regulations may be cited as the Cattle Identification Regulations 2007; they apply in England and come into force on 6th April 2007.</Text>

<P1group RestrictExtent="E+W+S+NI+i" id="p00072" RestrictStartDate="2020-12-31"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2007/529/regulation/2" IdURI="http://www.legislation.gov.uk/id/uksi/2007/529/regulation/2" id="regulation-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2007/529/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/uksi/2007/529/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“cattle” means bovine animals, including bison and buffalo;</Text></Para></ListItem><ListItem><Para><Text>“cattle passport” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text><Substitution ChangeId="key-a8a3b515362bde252c982fcafe989282-1637698459753" CommentaryRef="key-a8a3b515362bde252c982fcafe989282">a cattle passport issued in England under regulation 6 of, and schedule 3 to, these Regulations or the equivalent measures in Wales or Scotland;</Substitution></Text></Para></ListItem><ListItem><Para><Text>a cattle passport issued under the Cattle Passports Order 1996<FootnoteRef Ref="f00005"/>; otherwise</Text></Para></ListItem><ListItem><Para><Text>the county council.</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“previous cattle tagging legislation” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>the Cattle Identification Regulations 1998<FootnoteRef Ref="f00007"/>;</Text></Para></ListItem><ListItem><Para><Text>the Bovine Animals (Records, Identification and Movement) Order 1995<FootnoteRef Ref="f00008"/>;</Text></Para></ListItem><ListItem><Para><Text>the Bovine Animals (Identification, Marking and Breeding Records) Order 1990<FootnoteRef Ref="f00009"/>;</Text></Para></ListItem><ListItem><Para><Text>the Tuberculosis (England and Wales) Order 1984<FootnoteRef Ref="f00010"/>; connection with records, and may require any person having charge of, or otherwise concerned with the operation of, the computer, apparatus or material to afford him such assistance as he may reasonably require;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2007/529/regulation/10/3/f" IdURI="http://www.legislation.gov.uk/id/uksi/2007/529/regulation/10/3/f" id="regulation-10-3-f"><Pnumber>f</Pnumber><P3para><Text>where records are kept by means of a computer, require the records to be produced in a form in which they may be taken corporate</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2007/529/regulation/14" IdURI="http://www.legislation.gov.uk/id/uksi/2007/529/regulation/14" id="regulation-14"><Pnumber>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2007/529/regulation/14/1" IdURI="http://www.legislation.gov.uk/id/uksi/2007/529/regulation/14/1" id="regulation-14-1"><Pnumber>1</Pnumber><P2para><Text>Where a body corporate is guilty of an offence under these Regulations, and that offence is proved to have been committed with the consent or <Title>Change of ear tag number</Title>

<Text>If an animal born before 1st January 1998 is re-tagged with a different ear tag number, the keeper must, within 14 days of the new ear tag being attached and in any event before the animal is moved off the holding, notify the Secretary of State of the new ear tag number and return the old cattle passport with an application for a new cattle passport to be issued with the new ear tag number, and failure to do so is an offence.</Text>

<Title>Registration of birth</Title>

<P2para><Text>When a calf is born its keeper must register it within 7 days from the date it is tagged (or, in the case of a dairy herd, from the date on which the second ear tag is applied to the animal).</Text>

<Pnumber>1</Pnumber>
<P2para><Text>For the purposes of Article 7(4) of Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2000/1760" id="c00082" Class="EuropeanUnionRegulation" Year="2000" Number="1760">(EC) No. 1760/2000</Citation>, the register must be kept for 10 years in the case of a farm and 3 years in any other case, in both cases from the end of the calendar year in which the last entry was made; and any record made under the Bovine Animals (Records, Identification and Movement) Order 1995 must be kept for the same period.</Text>

<Title>Principal changes</Title>
<P><Text>The principal changes are as follows.</Text></P>
<P><Text>The Regulations now allow bison to be tagged up to 9 months after birth (paragraph 1(3) of Schedule<Character Name="NonBreakingSpace"/>1).</Text></P>
<P><Text>They create an offence of transferring eartags between animals (paragraph 4(5) of Schedule 1 and of re-using an ear tag (paragraph 4(6) of that Schedule).</Text></P>
<P><Text>They no longer permit the use of temporary calf passports.</Text></P>
<P><Text>They permit electronic registration of cattle (paragraph 2(3) of Schedule 2).</Text></P>
<P><Text>They change the £50 fee for replacement passports to a fee reflecting the cost of issue (paragraph 4 of Schedule 3).</Text></P>
<P><Text>They simplify the provisions on records (Schedule 5).</Text></P>

<P><Text>They provide for notification of a holding to the Secretary of State if cattle are kept there (regulation 3).</Text></P>
<P><Text>They make provision for eartags (regulation 4 and Schedule 1), registration of cattle (regulation 5 and Schedule 2), passports (regulation 6 and Schedule 3) and notification of movement and death (regulation 7 and Schedule 4).</Text></P>
<P><Text>They provide for records to be kept in the form specified in Schedule 5.</Text></P>
<P><Text>They provide for the enforcement of the Regulations (Part 4). They are enforced by the local authority (regulation 16).</Text></P>
<P><Text>Breach of the Regulations is an offence, punishable—</Text><P3>

<Text>on summary conviction, by a fine not exceeding the statutory maximum or to imprisonment not exceeding three months or to both;</Text>
