Section 138 of the Water Industry Act 1991 M1 is amended as follows.

In subsection (1A), for the words “any installation or plant or otherwise carrying on any activity”, substitute “ any Part A installation or Part A mobile plant or otherwise carrying on any Part A activity ”.

In subsection (1B)(a) for the words “regulations under section 2 of the Pollution Prevention and Control Act 1999” substitute “ the Environmental Permitting (England and Wales) Regulations 2007 (“the 2007 Regulations”) ”.

After subsection (1B)(a), insert—

In subsection (1B)(b) for the words from “granted” to the end, substitute “ granted under the 2007 Regulations ”.
